Wills & Trusts
You worked hard to build your estate. You naturally want your family and friends, or the charitable organizations of your choice, to receive as much of your estate as possible, as quickly as possible, and at the lowest possible cost. If you fail to plan your estate properly, however, the government will make your choices for you, at a tremendous cost.
Our office provides a full range of estate planning services, including wills, revocable living trust, a revocable trust, living wills, powers of attorney and living wills. Moreover, unlike many law offices, our office will work with you in the complex task of funding your trust.
Please note, however, that not every estate planning tool is right for everyone. We will take the time to listen to your goals and to determine what estate plan is right for your needs and circumstances.
We also realize that not everyone has the ability to come to our offices. We can meet you at your home if that is more convenient for you.

Probate Administration & Litigation
Our office has extensive experience in handling all aspects of probate administration, in a friendly, expeditious and cost effective manner. Also, unlike many estate attorneys, Roger D. Smith has 35 years of experience litigating cases. He will provide aggressive and thorough representation if litigation becomes necessary. We do not push you to turn simple matters into major fights. At the same time, if your opponent is unreasonable, we will litigate aggressively to protect your interests. We are prepared to fight cases all the way through the appellate courts if necessary.
Family Law
When families breakup, there is a significant amount of stress on the spouses and on their children. This is not the time to stumble around with an inexperienced attorney. Mr. Smith has 35 years of experience in handling all types of family law issues. He also served as a judge pro tem in Maricopa County Family Court for many years.
The sad reality is that family law litigation can be quite expensive. You owe to yourself explore all settlement options before diving into an all-out-war. This is particularly true when children are involved. However, if your children are at risk, and/or if your spouse is unreasonable, you need an experienced litigator on your side.
Your case, moreover, will not necessarily end in the trial court. Mr. Smith has had extensive experience in arguing cases and the Arizona appellate court system.

Civil & Family Court Appeals
Cases do not necessarily end when the trial court enters judgment. The trial judge or jury does not always get it right. Most attorneys, however, are inexperienced in the complexities of the appellate court system.
Roger D. Smith has 35 years experiencing appellate court matters. He formerly clerked for the Arizona Court of Appeals. He handles Civil and Family Court appeals, special actions, and post judgment/decree matters.
